A contested estate in the courts commonly runs for years and costs a great deal more than the parties expect — and the bill is usually paid out of the very estate everyone is fighting over. The relationships rarely survive it. Mediation exists because there is another way to end this.遗产争议一旦进入法庭,往往拖上数年,费用也远超各方预期——而这笔账,通常就从大家争夺的那份遗产里扣。关系很少能熬过这一程。调解之所以存在,是因为结束这件事,还有另一条路。

In court there is a winner and a loser, and the loser is family. In mediation, the aim is an outcome each person can live with and defend to their own children — the house dealt with, the money divided, the promise honoured, and the relationships still standing on the other side of it.在法庭上有赢家也有输家,而输的那一方,是家人。在调解里,我们要的是一个每个人都能接受、也能向自己孩子交代的结果——房子有了安排、钱有了分配、承诺得到履行,而关系,在这一切之后依然还在。

That is not naive optimism. It works because the room is private, because nothing said can be used later, and because someone in it is responsible only for the agreement — not for winning.这不是天真的乐观。它之所以有效,是因为房间是私密的、说过的话日后不能被拿来用,而且房里有一个人,只对「达成协议」负责,不对「赢」负责。

Choose the shape that fits your family. The fee for whichever you choose is fixed, quoted to you in writing before anything begins, and normally shared equally between the parties — so nobody is buying an advantage. The quotation covers the mediation itself and the settlement agreement; disbursements, court filing fees, valuations, and the conveyancing or probate work needed to carry out what you agree are quoted separately. What families ask before they say yes.家庭在答应之前,通常会问的。

Is what we say in mediation private?调解中所说的话是保密的吗?

Yes. Mediation is conducted privately and on a without-prejudice basis, which means what is said in the room is not evidence that can be used against anybody later in court. That is precisely what makes people willing to be honest.是的。调解以私密方式进行,并属「不损权益」(without prejudice)性质——房间里说的话,日后不能在法庭上作为对任何人不利的证据。正因如此,人们才愿意说真话。

Is the mediator on anyone's side?调解员会偏袒某一方吗?

No — and this matters. As mediator the role is neutral: we do not act as solicitor for any party in the dispute, and we do not give one side legal advice against the other. Each party remains free to have their own lawyer, and we will work with them.不会——这一点很重要。担任调解员时,角色是中立的:我们不会在该纠纷中担任任何一方的代表律师,也不会为其中一方提供针对另一方的法律意见。各方仍可自行聘请律师,我们会与他们协作。

What if we do not reach an agreement?如果我们谈不成呢?

Then you have lost some hours and a fraction of what a trial costs — and you will usually have narrowed the dispute, which makes anything that follows shorter and cheaper. Nobody is forced to settle. You can walk away at any point.那么您损失的只是几个小时,以及审讯费用的一小部分——而且争议范围通常已经缩小,接下来的程序也会更短、更省。没有人被迫和解。您随时可以离开。

Is a settlement agreement legally binding?和解协议具有法律约束力吗?

A properly drafted settlement agreement is a contract between the parties and is enforceable as such. Where court proceedings have already been filed, terms can be recorded as a consent judgment so that they carry the weight of a court order.妥善拟定的和解协议是各方之间的合约,可依合约强制执行。若已入禀法庭,条款也可记录为同意判决(consent judgment),从而具备法庭命令的效力。

Everyone lives in different states. Must we all be in the room?大家住在不同州属,一定要全部到场吗?

It is better in person, but not essential. Sessions can be run online or in a hybrid format where one or two family members join by video.面对面较好,但并非必须。调解可以线上进行,也可采混合模式,让一两位家人以视讯方式参与。
